1. Terms and Conditions of Internet-banking Service:
1.1 This document is subject to all internet banking terms and conditions issued by the Bank of Khartoum (the "Bank"), and will be interpreted in accordance with Sudanese laws and regulations issued by CBOS.
1.2 These terms and conditions are subject to the Memorandum of Association of the Bank of Khartoum (the "Bank") as well as its Articles of Association. They are executed according to the Bank's Articles of Association, internal policies and regulations and the legal opinions issued by the Bank's Sharria Board, to the policies, regulations, instructions and directives of the Central Bank of Sudan ("CBOS") and to the applicable laws of Sudan as these terms and conditions are not inconsistent with the Islamic Sharria' principles and teachings nor with those of the applicable laws.
1.3 The Bank may provide Internet Banking Service for any customer subscribed on bankak service.
1.4 The Internet Banking Service allows the Customer to effect banking transactions through the internet including - except cash withdrawal- deduction from the account, credit, transferring money, obtaining bank statements and other services that the Bank can provide through the internet from time to time.
1.5 The Customer agrees and shall held liable for using same Bankak login credentials for login the Internet Banking Services platform with an additional step of verifying OTP one-time password when logging and executing any financial transactions.
2. Terms of Use of Internet Banking Service:
2.1. The transactions through the Internet Banking Service- accepted by the Bank- shall be affected upon request by the Customer.
2.2 The Bank has the right to deduct the prescribed fees on these transactions directly from the Customer's account. The Bank may amend the fees from time to time. The Customer should check before doing any transaction to ascertain that his credit covers the transaction together with the prescribed fees.
2.3 The Bank shall not be held liable if the amount of the transaction has decreased as a result of deducting the applicable fees.
2.4. The Bank shall not be held liable in case the Customer cannot access the Internet Banking Service due to a malfunction in the network, a power outage or any general outrage or as a result of seizing the Customer's account or issuance of garnishee order by a court or any other competent authority that has such power by virtue of the law, or as result of set off or netting exercised by the Bank to settle indebtedness of the Customer towards the Bank.
2.5 The Bank shall not be held liable for any loss or damage incurred by the Customer as a result of using Internet Banking Service to settle bills or charges to any other body.
2.6 the Customer alone shall be responsible of the accuracy of the information and date s/he enters and of the amendment of fees, charges, information or data. The Customer should settle any dispute about the amounts transferred or that deducted with that concerned body.
2.7 The Customer shall indemnify and hold the Bank harmless of any loss incurred. The Customer agrees that the records kept by the Bank for the transactions effected by the Customer are conclusive evidence as to the trueness and accuracy of the transactions. If any dispute arises between the Bank and the Customer about an amount
shall not be liable for any transaction effected before the Customer notifies the Bank. The Customer shall indemnify the Bank against any loss incurred as a result of failure to notify the Bank of such incident.
2.9. The Bank shall not be held liable of any use, entry or hacking of Customer account through the internet by any third party by using any cheating or any malicious means; the Bank is exempted from any liabilities, claims, obligations or rights that may arise from or in relation to the use of the Internet Banking Service in connection to the Customer's account, information and data related to the transactions that transmitted through the internet.
2.10. The Customer agrees that the Bank has the right at any time to halt the Internet Banking Service without conveying any reasons for this and without prior notification.
